Terms of Service

1. Acceptance of Terms

These Terms of Service (the “Terms”) form a binding agreement between you and Technology Geeks, Inc. (“VisibilityIQ,” “we,” “us,” or “our”), the operator of the VisibilityIQ platform. By creating an account, starting a subscription, or otherwise accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Definitions

• “Service” means the VisibilityIQ technical-SEO and AI-visibility audit platform, including the dashboard, audit engine, connectors, APIs, and related websites and software we make available.
• “Account” means the credentialed access we provision for you and your organization to use the Service.
• “Subscription” means a paid plan that grants access to the Service for a recurring fee on a monthly or annual interval.
• “Content” means the data, URLs, domains, audit inputs, connector data, and other materials you submit to or generate through the Service.

3. The Service

VisibilityIQ is a technical-SEO and AI-visibility audit platform. The Service crawls and analyzes the websites you authorize and produces structured findings and remediation guidance. Core capabilities include:

• Site audit — crawlability, indexation, canonical correctness, raw-vs-rendered parity (crawling each URL as raw HTML and again with a headless browser, then diffing the two), and structured-data validation.
• Rank tracking — organic position monitoring with SERP-feature detection.
• Competitor intelligence — keyword and gap analysis against publicly available competitor data.
• AI-crawler visibility — auditing how AI web crawlers (such as GPTBot, ClaudeBot, and PerplexityBot) can access and parse your content, including llms.txt validation and AI-crawler access scoring.

We may add, change, or remove features over time. We will not make a material reduction to the core capabilities of a plan you are paying for during your current billing period without notice.

4. Accounts and Eligibility

You must be at least 16 years old to create an Account and use the Service. You agree to provide accurate, current, and complete information when registering and to keep it up to date. You are responsible for safeguarding your credentials and for all activity that occurs under your Account, whether or not you authorized it. Notify us promptly at support@visibilityiq365.com if you suspect any unauthorized use of your Account. We may suspend or terminate Accounts that contain false information or that are used in violation of these Terms.

5. Subscriptions and Billing

The base subscription is $39.95 per month (Introductory Rate) and includes 2 domains. Each additional domain is $18.95 per month, billed together with your base subscription on the same monthly invoice. An annual option is available at $439.45 per year (the equivalent of $36.62 per month), billed once up front and auto-renewing every 12 months. All plans auto-renew until cancelled.

5-day money-back guarantee. If you are not satisfied within the first 5 days of a new subscription, contact support for a full refund of that subscription charge.

Cancellation. Monthly plans can be cancelled at any time through self-serve account controls; cancellation takes effect at the end of the current billing period, and you retain access until then. Annual plans can only be cancelled by VisibilityIQ on request — to cancel an annual plan, contact us at support@visibilityiq365.com and we will process the cancellation for you.

Taxes may apply and, where applicable, will be added to your charges. We may change prices with advance notice; any price change applies at your next renewal, never mid-term. Payments are processed by Stripe; by subscribing you also agree to Stripe’s applicable terms. Except for the 5-day money-back guarantee described above, fees are non-refundable and are not prorated for partial periods.

6. Acceptable Use

You may use the Service only to audit websites that you own or are authorized to manage. Competitor analysis is limited to publicly available data and must respect each target site’s robots.txt directives. You agree that you will not:

• use the Service to crawl, probe, scrape, or attack any site you are not authorized to access;
• use the Service for any unlawful purpose or in violation of any applicable law or third-party right;
• reverse engineer, decompile, or attempt to derive the source code of the Service;
• resell, sublicense, or commercially redistribute the Service without our prior written permission;
• overload, disrupt, or impair the Service or the infrastructure it runs on, or circumvent its rate limits or access controls.

You are solely responsible for ensuring you have authorization to audit any domain you add to your Account.

7. Customer Data and Ownership

You retain all ownership of your Content, including the domains, audit inputs, and connector data you submit. You grant VisibilityIQ a limited, non-exclusive license to host, process, and analyze your Content solely to operate and provide the Service to you, including running audits, generating findings and remediation artifacts, and improving the reliability of your results. We process your Content as described in our Privacy Policy. We do not sell your Content.

8. Third-Party Services and Connectors

The Service integrates third-party services and data sources, including Stripe (payments), Cloudflare (infrastructure), and Google, Bing, and other providers (search, analytics, and crawl data). Your use of any connected account is also subject to that provider’s own terms and policies. When you connect a data source, you authorize VisibilityIQ to access the relevant data on your behalf — typically via OAuth — solely to provide the Service. You can revoke that authorization at any time through the provider or through your Account, though doing so may limit Service functionality. We are not responsible for the availability, accuracy, or acts of third-party services.

9. Intellectual Property

VisibilityIQ and its licensors own all rights, title, and interest in and to the Service, including the platform, software, audit engine, scoring models, documentation, and the VisibilityIQ name, logo, and brand. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service during your Subscription, and no other rights. Nothing in these Terms transfers ownership of the Service or our intellectual property to you.

10. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any particular SEO, ranking, traffic, or AI-visibility outcome. Audit findings, scores, and remediation suggestions are informational only, are generated in part by automated analysis, and do not constitute professional, legal, or financial advice. You are responsible for reviewing and validating any change before applying it to your site.

11. Limitation of Liability

To the maximum extent permitted by law, VisibilityIQ will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the Service. Our total aggregate liability for any claim arising out of or related to these Terms or the Service will not exceed the amount you paid to VisibilityIQ for the Service in the twelve (12) months preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless VisibilityIQ and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your Content, your use of the Service, your violation of these Terms, or your violation of any applicable law or third-party right — including any unauthorized crawling or analysis of sites you were not authorized to audit.

13. Termination

You may stop using the Service and cancel your Subscription as described in Section 5. We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay fees when due, or use the Service in a way that creates risk or legal exposure for us or others. On termination, your right to use the Service ends. We will make your Content available for a reasonable period after termination where practicable, after which it may be deleted in accordance with our data-retention practices and the Privacy Policy. Sections that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and indemnification — survive.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules, and any dispute arising out of or related to these Terms or the Service will be subject to the exclusive jurisdiction and venue of the state and federal courts located in Cobb County, Georgia. The parties will attempt in good faith to resolve any dispute informally before initiating formal proceedings.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Changes take effect when posted unless stated otherwise. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
